INJURED WORKER DAY OF PROTEST & MEMORIAL DAY 2003

On Monday, Injured Workers of Pennsylvania took many workers compensation issues to Harrisburg.  They are tire of being denied their rights under Act 57 and tired of being blamed for the high cost of workers compensation.  Injured workers reminded the legislators that workers gave up the right to sue an employer for a worker related injury in exchange for no fault workers compensation.  They want to know what happened to workers compensation and why it is being denied to so many.  Worker's Compensation fraud committed by employers and insurers was the number one topic.

Issues Covered at the Protest

  1. Fraud committed against injured workers by employers and insurers

  2. Failure of the Independent Medial Exam aspect of Act 57

  3. Improper usage of the AMA's "Guide to the Evaluation of Permanent Impairment"

  4. No cost of living raises for 32 years

  5. Time limit on a claim

  6. No rules for evidence

  7. Wrongful usage of Vocational Rehab Experts

  8. Exclusivity clause of Act 57 is flawed

  9. Denial of legitimate claims without penalty

  10. Ex-parte communication of medical records

  11. No Social Security donations to an injured workers account while on Workers Compensation

  12. No Medicare donations to an injured workers account while on Workers Compensation

  13. Failure of the Insurance Commissioner to investigate fraud complaints file by injured workers

  14. Failure of the Attorney General to prosecute fraud complaints against employers filed by injured workers
